Legal bases for the InnovaGoods raffle with Van Go motorhomes - 02/08/2022

I. PURPOSE OF THE PROMOTION

    The purpose of the contest is to promote the InnovaGoods brand through a campaign developed on Instagram in collaboration with Autocaravanas Van Van GO. This promotion will take place nationwide on August 2, 2022, and will be active until August 16, 2022.
    Their mechanics are indicated in the following exhibits:

    II. ORGANIZING COMPANY

    The organizer of the promotion is Nine New Investments LLC, (hereinafter, InnovaGoods), with C.I.F. B98019235, with an address at  C/ Enguera 7, 46018 Valencia, entity to which all communications and notifications related to its development should be addressed.

    III. RESPONSIBILITY OF THE ORGANIZERS

    1. Participation through the Internet: InnovaGoods excludes any liability for damages of any kind that may arise from the temporary lack of availability or continuity of the operation of telecommunications networks.
    2. Modifications and/or annexes: InnovaGoods reserves the right to make modifications or add successive annexes regarding its mechanics and prizes, as long as they are justified or do not harm the participants, and are duly communicated to them.
    3. InnovaGoods will not be responsible for delays, losses, or damages in shipments that may occur due to causes not attributable to it. The organizer will also not be liable for cases of force majeure (such as strikes, etc.) that may prevent the winner from fully or partially enjoying their prize. InnovaGoods will be exempt from all liability if any of the aforementioned cases occur.
    4. In the event that this promotion cannot be carried out, either due to detected fraud, technical errors, or any other reason beyond the promoter's control, which affects the normal development of the promotion, InnovaGoods reserves the right to cancel, modify, or suspend it.

       IV. INSTAGRAM'S RESPONSIBILITY

      According to the provisions of the current promotion policies for Instagram, it should be noted that:

      1. Instagram does not sponsor, endorse, or administer this promotion in any way, nor is it associated with it.
      2. The information provided by participants in the context of this promotion will be exclusively managed by InnovaGoods (not by Instagram), in accordance with the provisions of sections XI (assignment of rights) and XII (assignment of personal data) below.
      V. REQUIREMENTS TO PARTICIPATE IN THE PROMOTION

      The participants in this promotion must (i) be of legal age and (ii) reside in Spain. 

      It will be an essential requirement to comply with the conditions established in these bases in order to participate in the contest. All data provided by the participant must be truthful. The identity of the participants and winners will be accredited exclusively through official documents. In the event that the participant has provided false data, their participation will not be taken into account and they will be excluded from the promotion and the possibility of winning any prize.

      The participation in the contest implies acceptance of these legal bases.

      By participating in this contest, participants automatically consent to the use, publication, and reproduction worldwide and without limitation, by InnovaGoods, of their image and name, as well as responses and comments, in any type of advertising, promotion, publication, including the Internet, or any other medium of any nature, for commercial or informational purposes as long as they relate to this Promotion, without any reimbursement of any kind for the participant and without the need to pay any fee.

      VI. PARTICIPATION IN THE PROMOTION

      During the promotional period and through a publication, the possibility of participating in the raffle announced by @innovagoods_official and shared by @autocaravanasvanvango will be announced, and to win the corresponding prize, which consists of a motorhome with capacity for 4 people for a weekend* (see section VII) and a paddle surf board brand InnovaGoods.

      To participate, users must:

      • Fill out and submit a form on the InnovaGoods website
        (https://sorteo-caravana.subscribemenow.com        ).
      • Follow @innovagoods_official and @autocaravanasvanvango on Instagram.
      • Mention at least one person in the giveaway post.
      • Like the post.

      The mentions received via direct message will not be read immediately. Once the name of the winner is extracted from the comments, we will proceed to review the compliance with the other requirements.

      The winner will be chosen through a random draw using the Sorteiogram app (or, if not available, a similar app).

      The same day of the draw, a screen recording will be made and uploaded to stories announcing the winner.

      VII. AWARDS

      The prize consists of the use of a motorhome with a capacity for 4 people for a weekend, and an InnovaGoods paddle surf board. The winner must contact Autocaravanas Van Van Go through their Instagram (@autocaravanasvanvango) to arrange the days and redeem their prize.

      * The rental of the motorhome will be carried out according to the criteria of Van Van Go Motorhomes.

      To keep in mind:

      • You will enjoy the motorhome for a weekend in the low season: November, February, March, and April. It does not include Holy Week.
      • The motorhome can be picked up at one of the Van Van Go branches in: Galicia, Valencia, Bilbao, Irún-Hondarribia, Madrid, Barcelona, Algeciras, or Mallorca.
      • A deposit of €600 will be made, to be refunded once the trip is over, provided there are no damages.
      • The driver must be over 25 years old

      The validity date to make the trip in a motorhome is 1 year from the announcement of the contest winner. This date may be extendable if total mobility restrictions (lockdown) are established.

      In regards to the InnovaGoods paddle surf table, the winner will be able to receive it during the week following the resolution of the draw. If a delivery date is requested after that period, it will be agreed upon via Instagram.

      The prizes are personal and non-transferable. Under no circumstances will the prizes be exchanged for their cash value.

      VIII. DELIVERY OF THE PRIZE

      Through Instagram, InnovaGoods will contact the winner via a private message requesting their contact details and informing them of all the steps to follow.

      The winner must expressly accept the prize by responding to this message within 3 business days from its sending.

      IX. EXCLUSION AS PARTICIPANTS

      They will not be able to participate in the contest nor therefore be selected:

      1. The employees of BigBuy Group and Van Van Go Motorhomes.
      2. The direct relatives (parents, siblings, or children) of the individuals included in point 1.
      3. The spouses of all the individuals included in points 1 and 2.

      InnovaGoods reserves the right to request reliable personal accreditation from the participants.

      If the winner who opts for the prize does not meet the requirements set forth in these rules, or the data provided to participate is not valid or does not provide the necessary data requested, which may include a copy of their ID, they will not be eligible for the prizes subject to this promotion. 

      X. DETECTION OF FRAUDULENT PARTICIPATION

      InnovaGoods reserves the right to exclude from this promotion those users who it suspects or detects have participated in any fraudulent manner, including manipulation of the software program, and may request any type of documentation from the participants. In the event that the participant cannot or does not want to provide any requested document, they will be immediately removed from the promotion.

      If the participant does not meet the requirements set forth in these rules, or if the data provided to participate is not valid or if they do not provide the necessary information requested, which may include a copy of their ID, they will not be eligible for the prize subject to the promotion.

      InnovaGoods reserves the right to justifiably remove any participant who defrauds, alters, or disrupts the proper functioning and normal and regulatory course of the promotion.

      XI. ASSIGNMENT OF RIGHTS

      Participants in this promotion will transfer to InnovaGoods all rights derived from the use of their works, data, opinions, images, and/or voice that may be made within the framework of this promotion.

      XII. ASSIGNMENT OF PERSONAL DATA

      By participating in this promotion, you expressly consent that your data will be processed by Nine New Investments S.L,  with C.I.F. B98019235, as the data controller, for the purposes of informing and requesting your opinion on offers, products, and services of the mentioned company and conducting market studies, through any means, including e-mail or SMS, as well as to carry out treatments in order to tailor our communications to your particular profile (all of this in case you have requested any of this data).

      We inform you that if you wish to revoke the consent granted, as well as exercise your rights of access, rectification, cancellation, opposition, or data portability, or that the same not be used to offer you information from third companies, please contact a Nine New Investments S.L, (To the Customer), C/ Enguera 7, 46018 Valencia, España.

      XIII. CHARTER

      The participants and the organizing company agree that any disputes that may arise in the interpretation or execution of these rules will be subject to the jurisdiction of the Courts and Tribunals of Valencia Capital.
